Terms and Conditions of Use

1. Acceptance of Terms

By downloading, installing, or using any application or game published by PIQTURE NEW MEDIA, SLU ("Piqture Games", "we", "us"), you ("the user") accept these Terms and Conditions in their entirety. If you do not agree, please do not use our applications.

3. Service Description

Piqture Games is an indie studio that develops and publishes games and applications for iOS and Android mobile devices. Our catalog includes:

• Free games that may contain advertising and/or optional in-app purchases
• Paid games with a single download price
• Hybrid games with free basic content and premium paid content

4. Eligibility

To use our applications, the user must be at least 16 years old. Minors below this age may only use them with the express consent and supervision of a parent or legal guardian, who will assume full responsibility for the use and any purchases made.

5. License of Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use our applications solely for personal, non-commercial use, on devices that you own or have the right to use.

This license grants no ownership rights over the software or its content.

6. User Accounts

Some applications may require the creation of an account. The user is solely responsible for:

• Maintaining the confidentiality of their credentials
• All activities carried out with their account
• Notifying us immediately of any unauthorized use
• Providing truthful and updated information

7. In-App Purchases

Our applications may offer in-app purchases of digital goods such as:

• Virtual currencies and game items
• Ad removal
• Unlocking of levels, characters or content
• Recurring subscriptions (where applicable)

Important:

• All purchases are processed exclusively through Apple App Store or Google Play, depending on the platform. We never request banking data directly.
• Virtual goods purchased have no real monetary value and are not refundable, transferable, exchangeable, or redeemable for real money outside the context of the game.
• Virtual currencies and items are only valid within the application in which they were acquired.
• Minors must obtain consent from parents or guardians before making any purchase.

8. Subscriptions

If an application offers subscriptions, these renew automatically at the end of each period unless cancelled at least 24 hours before expiration. Cancellation must be managed from the user's Apple or Google account settings.

9. Refunds

All refunds are governed by Apple App Store and Google Play policies, not by Piqture Games. To request a refund, the user must contact the corresponding platform directly:

• Android: support.google.com/googleplay

We do not issue direct refunds as we do not process payments directly.

10. Prohibited Conduct

The user agrees NOT to:

• Use cheats, exploits, automation, bots, or unauthorized software to modify game behavior
• Reverse engineer, decompile, or disassemble the software
• Access or attempt to access other users' accounts
• Sell, buy, or trade accounts, currencies, or virtual items outside the game
• Impersonate other people
• Post offensive, illegal, defamatory content, or content that infringes third-party rights
• Use the applications for unauthorized commercial purposes
• Interfere with the normal operation of servers or services

Violation may result in suspension or termination of the account without refund.

11. Intellectual Property

All intellectual and industrial property rights over the applications, including source code, graphics, sounds, music, characters, trademarks and logos, are the exclusive property of PIQTURE NEW MEDIA, SLU or its licensors.

Reproduction, distribution, public communication, transformation, or any other act of exploitation without express authorization is prohibited.

12. User-Generated Content

If an application allows the user to create or publish content (names, messages, screenshots, etc.), the user grants us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, and display such content for the purpose of operating the application.

The user warrants that they hold the rights to the published content and indemnifies us against any third-party claims.

13. Advertising

Some free applications may display advertising from third-party networks (such as Google AdMob, Unity Ads, etc.). This advertising is governed by the policies of each ad network. Advertising may be removed via in-app purchases when the application allows.

14. Service Availability

We strive to keep our applications available, but we do not guarantee uninterrupted, error-free operation or compatibility with all devices. We may modify, suspend, or discontinue any application or feature at any time, with or without prior notice.

15. Modifications and Updates

We may release software updates that may add, modify, or remove features. Some updates may be mandatory in order to continue using the application.

16. Termination

We may suspend or terminate your access to the applications in case of breach of these terms. The user may stop using the applications at any time by uninstalling them. Termination does not entitle the user to a refund of virtual goods purchased.

17. Limitation of Liability

To the maximum extent permitted by law, PIQTURE NEW MEDIA, SLU shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, opportunities, or virtual goods
• Malfunction arising from device or connection incompatibilities
• Acts of third parties (advertising networks, distribution platforms, etc.)

Our maximum liability for any claim shall be limited to the amount actually paid by the user in the previous 12 months.

18. Indemnification

The user agrees to indemnify and hold PIQTURE NEW MEDIA, SLU harmless from any claim, damage, or expense arising from improper use of the applications or breach of these terms.

19. Governing Law and Jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Lleida (Spain), unless consumer protection regulations establish a different jurisdiction.

20. Changes to These Terms

We may update these terms periodically. Changes will be published on this page with the new update date. Continued use of the applications after changes constitutes acceptance of the modified terms.
